Save The Bays challenged the government’s decision to allow the developer of Nygard Cay to carry out illegal construction, dredging and land reclamation activities in the area surrounding Clifton Bay.
The activities posed a threat to Clifton Bay, home to coral reef and conch populations and critical for the local diving and snorkeling industry. As well as seeking to immediately protect the Clifton Bay area, STB also wished to encourage effective land-use planning decisions and prevent unregulated development on environmentally significant land in The Bahamas.
In 2018 the court ruled in STB’s favor, confirming that the consultation process was flawed and that proper process must be followed in future before granting any permits.
